לבני משפחתנו, חברותינו וחברינו היקרים,
בפרשת שופטים, אותה נקרא מחר, מופיעה פרשה מעניינת, שתוכנה כבר מוזכר בסוף ספר במדבר: דינו של הורג אדם בשוגג ופרשת ערי מקלט.
המשנה והתלמוד מקדישים פרק שלם במסכת מכות לפירוט הדינים של אותו מוסד הנקרא "עיר מקלט".
דומני שהדין המקראי מלמד אותנו את ההבחנה בין אשמה לאחריות וגם שלא ניתן לעבור לסדר היום על הריגת אדם בידי אדם. כמו-כן, חז"ל מלמדים אותנו שערי מקלט אינם בית סוהר, אלא מקום המספק הגנה, אפשרות של התבוננות, חשבון נפש וכפרה ושיקום.
ואולי יש למשפט המודרני מה ללמוד במקרה הזה ממשפט התורה.

Dear Family and Friends,
At the end of the Torah section we'll read tomorrow, we'll read about a ceremony, after discovering a corpse and not finding the murderer, during which a calf is decapitated and sacrificed. During this ceremony, the "elders" (the leadership) after washing their hands over the decapitated calf at the stream shall speak up and say, 'Our hands have not spilled this blood, and our eyes have not witnessed it'.
According to our Sages, this reflects the moral responsibility of the leadership even if they weren't involved directly in this murder.
Maybe this teaches us that even now, when even marginal people act violently towards others, the entire society should feel responsible and think what could be done to avoid this.
